Terms of Service

Article 1 — Agreement to Terms

Users must agree to these Terms of Service (hereinafter "the Terms") in order to use the services provided by Big Other Inc. (hereinafter "the Company"). By using the service, you are deemed to have accepted the Terms.

Article 2 — Service Description

The Company provides the Resista application (hereinafter "the Service"), a financial education tool that includes receipt scanning, spending analysis, a location-based territory game, and an investment simulation feature. The Service is designed for educational purposes only and does not involve real money, real trades, or real financial products.

Article 3 — Registration

Use of the Service requires account registration through the method designated by the Company. The usage agreement is established upon completion of registration.

Article 4 — Account Information

Users must provide accurate and current information when registering and update any changes promptly. The Company bears no responsibility for damages resulting from inaccurate or outdated account information.

Article 5 — Account Management

Users are responsible for the management and security of their own accounts and passwords. The Company is not liable for any damage arising from unauthorized access to user accounts, except in cases of willful misconduct or gross negligence on the part of the Company.

Article 6 — Intellectual Property

All rights to the Service, including but not limited to software, content, designs, trademarks, and data, belong to the Company or its licensors. Users may not reproduce, modify, distribute, or create derivative works from any part of the Service without prior written consent.

Article 7 — Privacy

The handling of user information is governed by the Company's Privacy Policy, which forms an integral part of these Terms.

Article 8 — Prohibited Activities

Users shall not engage in any of the following activities:

  • Acts that violate laws, regulations, or public order
  • Acts that infringe on the rights of other users or third parties
  • Impersonation of other individuals or organizations
  • Unauthorized access to the Service's systems or infrastructure
  • Unauthorized collection, scraping, or reproduction of data from the Service
  • Interference with the operation or availability of the Service
  • Commercial use of the Service without prior written consent
  • Any other acts the Company deems inappropriate

Article 9 — User Responsibility

Users bear full responsibility for their actions while using the Service. In the event that a user causes damage to the Company or a third party, the user shall resolve the matter at their own expense and responsibility.

Article 10 — Disclaimer

The Service is provided for educational and simulation purposes only. The Company does not provide investment advice, recommend specific financial products, or guarantee any actual investment outcomes. Simulation results within the Service do not reflect or predict real market performance. Simulation Points have no real-world monetary value. Any actual investment decisions are made at the user's own risk and responsibility.

Article 11 — Limitation of Liability

The Company makes no warranties regarding defects, errors, or interruptions in the Service. The Company's liability for damages arising from the use of the Service shall not exceed a total of 100 yen, except where mandatory consumer protection laws apply.

Article 12 — Service Changes and Termination

The Company may modify, suspend, or terminate the Service with advance notice to users, except in cases of emergency where immediate action is required.

Article 13 — Anti-Organized Crime

Users represent and warrant that they are not members of, or affiliated with, organized crime groups (boryokudan), their associates, or related organizations. The Company may immediately terminate the account of any user found to be in violation of this article.

Article 14 — Modification of Terms

The Company may modify these Terms without advance notice. Modified Terms take effect upon publication on this website. Continued use of the Service after modification constitutes acceptance of the updated Terms.

Article 15 — Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan. In the event of any dispute arising from or in connection with these Terms, the parties shall first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached, the Kyoto District Court shall have exclusive jurisdiction in the first instance.
